Utkal Healthcare Limited operates the website utkalhospital.com and provides services through Partners. The Terms and Privacy Policy constitute a binding agreement between the hospital and users.
The agreement applies to:
- Patients, representatives, attendants, relatives, friends, or affiliates
- Website users generally
Users must read the agreement regularly, as modifications may occur. Continued website use after changes indicates acceptance. The agreement is governed by Indian law, including the Indian Contract Act 1872, Information Technology Act 2000, and related rules.
2. Conditions of Use
Users must be at least 18 years old to register and use services. By registering or using the website, users confirm they meet age requirements and have authority to use the platform and agree to comply with all terms.
3. End-User Account and Data Privacy
Information Collection
The hospital collects device information, location data, and usage analytics to improve services. "Utkal Hospital and its Partners may collect information relating to the devices through which you access the Website."
Account Responsibility
Users must maintain password confidentiality and are responsible for all account activity. Unauthorized use must be reported immediately to info@utkalhospital.in.
Information Accuracy
"If a User provides any information that is untrue, inaccurate, not current or incomplete...Utkal Hospital has the right to discontinue the Services."
Contact Updates
Users must keep mobile numbers and email addresses current. The hospital is not responsible for missed notifications due to outdated contact information.
Health Records
Users can manage personal health records through two categories:
- Patient-created information (user-generated)
- Utkal Hospital-created information (from medical services)
Users bear sole responsibility for accuracy of patient-created data and indemnify the hospital against related issues.
Health Reminders
Notification services are supplementary only. "Utkal Hospital is not liable if for any reason a reminder or notification is not delivered to you."
Dependent Records
Users registering dependents assume responsibility for those records and related obligations.
4. Listing Content and Disseminating Information
Practitioner Information
The hospital displays practitioner profiles including specialization, qualifications, fees, and location. "Utkal Hospital takes reasonable efforts to ensure that such information is updated at frequent intervals" but cannot guarantee accuracy.
Service Disclaimers
"The Services provided by Utkal Hospital...are provided on an 'as is' and 'as available' basis, and without any warranties."
Third-Party Links
The hospital is not responsible for linked websites' content, accuracy, or reliability. "Inclusion of any link on the Website does not imply that Utkal Hospital endorses the linked site."
Technical Issues
The hospital assumes no responsibility for viruses or equipment damage from website access or downloads.
Fraudulent Information
The hospital may suspend access and publicly declare suspension if users provide fraudulent or false information, with users liable for resulting losses.
5. Booking Appointments, Diagnostic Tests, Ordering Medicines and Interaction with Medical Service Providers
Appointment Confirmation
The hospital cannot guarantee confirmed appointments or prevent cancellations, postponements, or rescheduling by providers.
Telemedicine Services
Conversations via video, voice, chat, or text are recorded and stored per the Privacy Policy.
User Interactions
"Any interactions and associated issues with other Users...is strictly between you and the other Users" with the hospital not responsible.
Medical Advice Disclaimer
"The Services are not to provide any healthcare or medical advice or diagnosis."
Provider Liability
The hospital is not liable for:
- Wrong medication or treatment quality
- Provider no-shows or unavailability
- Appointment cancellations or fee variations
- Medical complications after service use
Feedback
The hospital is not liable for user feedback about providers and may moderate or withdraw feedback options at its discretion.
6. Online Payment on Website
Payment Gateway
Online payments are processed through third-party gateways. "This transaction will be governed by the terms and conditions and privacy policy of the third party payment gateway."
Payment Liability
The hospital is not responsible for failed transactions, bank declines, or third-party payment processor failures.
Cancellation and Refund Policy
Before scheduled appointment:
- 100% consultation fees refunded
- Convenience fees not refunded
After scheduled appointment:
- No refunds for consultation or convenience fees
Hospital-initiated cancellation (doctor unavailable):
- 100% refund of all fees
Refunds process within 7 working days via original payment source.
7. No Doctor Patient Relationship - Not for Emergency Use
No Medical Relationship
Information provision does not create a doctor-patient relationship. "The provision of such Information does not constitute an opinion, medical advice, or diagnosis or treatment."
Informational Purpose Only
Users rely on information at their own risk. The hospital is not liable for decisions based on website content.
Emergency Services
Users facing medical emergencies should contact ambulance services, hospitals, or doctors directly rather than using the website.
8. Content Ownership and Copyright Conditions of Access
Content Types

Copyright Protection
"Reproduction, re-transmission, public and/or commercial use of any or all the material on the Website and App are prohibited."
Authorized Use Only

9. Reviews and Feedback
User Responsibility

The hospital's role is limited to that of an "intermediary" under the Information Technology Act 2000, disclaiming responsibility for review content.
Prohibited Content
Users cannot post content that:
- Infringes third-party rights
- Violates applicable law, including IG Rules and SPI Rules
Feedback Contact
The hospital may contact users via phone, email, SMS, or electronic means for feedback purposes, and users agree to cooperate.
10. Rights and Obligations Relating to Content
Prohibited User Content
Users cannot upload, display, or share information that:
- Belongs to others without rights
- Is "grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic"
- Harms minors
- Infringes patents, trademarks, or copyrights
- Violates existing laws
- Contains misleading origin information
- Impersonates others
- Contains malicious software or code
- Threatens Indian sovereignty or public order
Prohibited User Actions
Users cannot:
- Violate website security or integrity
- Transmit disruptive or competitive information
- Submit incomplete, false, or inaccurate information
- Make unsolicited communications
- Use automated tools (spiders, robots) to navigate
- Reverse engineer website components

Content Removal

Hospital or Partner-owned trademarks cannot be used without express authorization.
Users cannot upload, post, or distribute copyrighted content without owner permission. Unauthorized distribution can result in "personal liability or criminal prosecution."
12. Termination
Suspension/Termination Grounds
The hospital may suspend or terminate access when:
- Users breach agreement terms
- Third parties report rights violations
- Hospital cannot verify submitted information
- Reasonable grounds for illegal or fraudulent activity exist
- User actions may create legal liability or contradict hospital interests
Access Loss
Terminated users cannot continue using the same account, different accounts, or re-register.
Data Loss
"On termination of an account...such User shall no longer have access to data, messages, files and other material."
Backup Responsibility
"The User shall ensure that he/she/it has continuous backup of any medical services."
13. Disclaimer of Warranties
"All information available on the Website or App...is provided on the condition that the User will make independent determination."
Information does not constitute invitation or recommendation for hospital services and is not professional advice substitute.
"All information...is provided to you 'as is' without warranty of any kind either express or implied."
The hospital is not liable for "special, direct, indirect or consequential damages" from information use.
14. Limitation of Liability
"Utkal Hospital neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data or information contained."
"In no event shall Utkal Hospital or its Partners be liable for any direct, indirect, punitive, incidental, special, consequential damages." Damages excluded include:
- Service use or inability to use
- Unauthorized access or data alteration
- Service-related matters
- Data loss or profit loss
- Website/app unavailability
The hospital is not responsible for service delays or inability to use services.
"The user understands and agrees that any material and/or data downloaded...is done entirely at his/her own discretion and risk."
15. Indemnity
Users agree to indemnify and protect the hospital, affiliates, officers, directors, employees, consultants, licensors, agents, and Partners from "any and all third party claims, losses, liability, damages, and/or costs" arising from:
- Website access or service use
- Agreement violation
- Intellectual property infringement
Users must assist in defending claims at their own expense.
16. Applicable Law and Dispute Settlement
"This Agreement...will be governed by the laws of India."
"The courts at Delhi shall have exclusive jurisdiction over any disputes arising out of or in relation to this Agreement."

18. Severability
If any agreement provision is deemed unenforceable, that provision is excluded while the remainder remains effective, interpreted to give maximum effect to the excluded provision's original intent.
